    1. Hello, we’re Careers Pty Ltd (ACN 623 789 855) (My Careers, we, us). We own, operate, and provide My Careers Software (Software), the My Careers services, and the My Careers website at www.mycareers.com (Website).

      • how we collect, hold, use or disclose personal information; 
      • the purposes for which we collect personal information;
      • what happens if we are not able to collect personal information;

    3. My Careers respects the rights and privacy of all individuals and is committed to complying with the Privacy Act 1988 (Cth) (the Act) and the Australian Privacy Principles and protecting the personal information we hold.

      • year level;
      • educational institution;
      • academic information;
      • age or birth date;
      • details of which of the services provided by My Careers you require or have enquired about, together with any additional information necessary for My Careers to deliver those services and to respond to your enquiries;
      • any additional information relating to you that you provide to us directly through our Website and Software, by phone or in person, or information you have provided indirectly through use of our Website and Software or online presence through our representatives or otherwise.

  4. HOW DOES MY CAREERS COLLECT PERSONAL INFORMATION?
    1. We collect your personal information directly from you unless it is unreasonable or impractical to do so. We do this in ways including: 
      • via your access and use of our Website;
      • via your access and use of our Software;
      • via someone else who has provided us with your information;
      • via education providers communicating directly with us;
      • via email communication between you and us; and
      • during conversations between you and us via phone;

When providing student, parent, staff or other personal information to us you must ensure that in doing so, you are complying with your own privacy obligations (including your obligations under your own privacy policy (if any) and any applicable law). By providing such information, you represent to us that you are doing so in a compliant way.  

  5. WHY DOES MY CAREERS COLLECT PERSONAL INFORMATION?
    1. The primary purpose for which we collect information about you is to enable My Careers to provide you with the services you request and to operate our business efficiently. We collect, hold, use and disclose your personal information for the following purposes:
      • to provide your personal information to prospective employers to enable them to communicate directly with you about employment opportunities;
      • to communicate with you, including but not limited to, by email, mail, SMS or telephone for the details of interviews, coaching appointments and/or billing purposes; 
      • to manage and enhance our services online;
      • to allow third party organisations and education providers to contact you to assist in the delivery of education and employment related services;
      • to provide you with information about other services available; 
      • to conduct business processing functions for operation of our Website or our Software; • for our administrative, service development, quality control and research purposes;
      • to provide your updated personal information to prospective employers, education providers or external service providers;
      • to investigate any complaints about or made by you, or if we have reason to suspect that you are in breach of any of our terms and conditions or that you are or have been otherwise engaged in any unlawful activity; and/or
      • as required or permitted by any law (including the Act)
    2. Your personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.

  6. HOW DOES MY CAREERS USE YOUR PERSONAL INFORMATION? TO WHOM WILL IT BE DISCLOSED?
    1. We may collect and disclose personal information to third parties for the purposes described in this policy. These purposes include but are not limited to:
      • Efficient communications between you and My Careers;
      • Effective communication between you and My Careers for the delivery of education and employment related services;
      • Contact between My Careers, prospective employers and education providers to deliver services to you;
      • Secure storage of your files to allow My Careers to deliver services to you; 
      • Management of your history to allow My Careers to deliver services to you efficiently;
      • Notifying you of education and employment material which may be suited to you.
    2. We may disclose your personal information to:
      • prospective employers or external service providers for the operation of our Website or Software including fulfilling requests made by you;
      • prospective employers and education institutions in order to enable them to deliver the services that you have requested; 
      • specific third parties authorised by you to receive information held by us;
      • the police, any relevant authority or enforcement body, or your Internet Service Provider or network administrator, for example, if we have reason to suspect that you have committed a breach of any of our terms and conditions, or have otherwise been engaged in any unlawful activity, and we reasonably believe that disclosure is necessary;
      • as required or permitted by any law (including the Privacy Act).
    3. By providing personal information, you consent to My Careers using it to:
      • provide you with products and/or services;
      • administer our relationship with you; 
      • monitor online activity on the My Careers Website; 
      • monitor online activity on the My Careers Software; 
      • market, improve and add to My Careers’ products and services (including online);
      • respond to a serious threat to an individual’s life or to public health or safety; 
      • respond to suspected unlawful activity; or 
      • where required or authorised by law.
    4. My Careers may disclose personal information to other related entities, officers, employees, agents in order to help achieve one of the purposes described above or as required by law.
    5. We may use your personal information for those purposes or for any other purpose listed on the Software collection statement at the point of collection if we ask for your consent first. 

  7. CAN YOU REMAIN ANONYMOUS OR WITHHOLD PERSONAL INFORMATION?
    1. Where practical, you may choose not to identify yourself, deal with us on an anonymous basis or use a pseudonym.
    2. If you do not provide us with the personal information described in this policy, some or all of the following may happen:
      1. My Careers may not be able to provide you with the services you requested, either to the same standard, or at all;
      2. My Careers may not be able to provide you with information about services that you may want or require;
      3. Education providers may not be able to forward necessary contact information, communicate with you or direct you to services you have requested;
      4. Prospective employers may not be able to contact you or provide you with information about the services you have requested; or 
      5. we may be unable to tailor the content of our Website or Software to your preferences and your experience of our Website and Software may not be as enjoyable or useful.

  8. WILL YOU RECEIVE DIRECT MARKETING?
    1. We may send you direct marketing communications and information about services that we consider may be of interest to you. These communications may be sent in various forms, including mail, SMS or email, in accordance with applicable marketing laws, such as the Spam Act 2004 (Cth). If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

    2. In order for My Careers to deliver the services you request, we at times may allow access to personal information to third parties including but not limited to:
      • Prospective employers;
      • Recruitment agencies; and
      • Education providers;
    3. We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website.
    4. Third party websites are responsible for informing you about their own privacy practices. We advise you check the privacy policy and terms and conditions of any third party website or business before using their services. 

  10. WILL YOUR INFORMATION BE DISCLOSED OVERSEAS?
    1. We will not disclose your personal information to any person or entity outside Australia. If this needs to change, we will inform you prior to any overseas disclosure and will provide the relevant details.
    2. If we are required to disclose personal information to other overseas persons or entities, we will take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

  11. HOW CAN YOU ACCESS AND CORRECT YOUR PERSONAL INFORMATION?

    3. If we suspect any misuse or loss of, or unauthorised access to, your personal information we may inform you of that suspicion and take immediate steps to limit any further access to, or distribution of, your personal information. If we determine that the breach is likely to result in serious harm to you and we are unable to prevent the likely risk of serious harm with remedial action, we will take action in accordance with the Privacy Act 1988 (Cth).

If we receive unsolicited personal information that we are not permitted to collect under this privacy policy, or within the confines of the law, we will destroy or de-identify the unsolicited personal information as soon as practicable if it is lawful and reasonable to do so. We will destroy or de-identify your personal information if we no longer require it to deliver our services as soon as practicable if it is lawful and reasonable to do so.

  13. DOES MY CAREERS USE “COOKIES”?
    1. When you use our Website, Software or services, My Careers or our service providers may obtain information using technologies such as cookies, tags, web beacons, and navigational data collection (log files, server logs, and clickstream data) to better understand your user experience. For example, My Careers or our service providers may collect information like the date, time and duration of visits and which webpages are accessed.
    2. When you access our Website or Software, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer. This enables us to recognise your computer and greet you each time you visit our Website or Software, without bothering you with a request to register or log-in. It also helps us keep track of products or services you view, so that we can send you news about those products or services.

    2. We will treat your requests or complaints confidentially. Our representative will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved. We will aim to ensure that your complaint is resolved in a timely and appropriate manner.
    3. If you are not satisfied with the outcome of our investigation, then you may request that an independent person (usually the Commonwealth Privacy Officer) investigate your complaint.
